May 2, 2016

        President John P. Griffin, Sr. called the meeting to order at 7:00 p.m.  Present were Town Commissioners Charles M. Rhodes, Jr., Edward C. Raffetto, Jr. and Town Attorney Karen Ruff, and B. Ross Rhodes Jr. Town Administrator, Nancy J. Lindyberg was excused.  See attendance sheet for other attendees.  President Griffin dispensed with the Pledge of Allegiance.  The minutes from the April 4, 2016 meeting were approved as submitted.

Opening of the sealed bids for Trash Removal for a three year period beginning July 1, 2016 through June 30, 2019.  Two bids were received:  Chesapeake Waste Industries LLC and Bates Trash Removal.  After review of the two bids, Commissioner Rhodes made a motion to accept the contract with Chesapeake Waste Industries LLC.  Commissioner Raffetto seconded the motion. The motion passed 3-0. The contract was awarded to Chesapeake Waste Industries LLC.

Committee Reports:

Planning & Zoning:    There is no meeting is required on Monday May 9, 2016.  The next meeting will be Monday, June 13, 2016.

Budget Status Report
:  Each Commissioner had a copy to review.

Open Meeting Act Training:  Nancy Lindyberg took the on-line training course for the Open Meeting Act and received a Certificate of Completion.

319 Main Street:
  Mr. Rick Jones provided the Commissioners with package detailing the terrible state of the house at 319 Main Street.  He indicated that the rear of the house is not far from collapsing and it is really a dangerous structure.  He included several pictures of the house for the Commissioners to review.  The Commissioners will further discuss the matter and make a decision at a later time.

Day Care Zoning:
Commissioner Raffetto stated that at the April 11, 2016 Planning and Zoning meeting discussion continued regarding the change in zoning to permit a larger number of persons to be care for in facilities which are large enough to care for that number and where there is adequate circulation and parking.  The recommendation of the Planning Committee was to permit this.  They request that the Town Commissioners direct Town Attorney Karen Ruff to prepare a draft ordinance to be presented at a future meeting.  Commissioner Raffetto made a motion to request that Town Attorney Karen Ruff to prepare an ordinance, for the consideration of the Commissioners, to permit a change in the current zoning to permit an increase of up to four (4) more persons.  Commissioner Rhodes seconded the motion.  The motion passed 3-0.

Other:
  Town Attorney Karen Ruff prepared a draft copy of the Town's FY17 Budget. Commissioner Rhodes made a motion to introduce Ordinance No. 159/16 approving and adopting the budget for the Town of Church Hill for the Fiscal Year beginning July 1, 2016 and ending June 30, 2017 establishing the tax  rate of $.34 per hundred of assessed evaluation for real property.  It maintains the current tax rate and a utility tax rate of $.85 per hundred of assessed evaluation and establishing a sewer fee of $315 per equivalent dwelling unit; and providing for the collection of the State of Maryland Bay Restoration Fund Annual Fee of $60.  Commissioner Raffetto seconded the motion.  The motion passed 3-0.  There will be a public hearing on Monday, May 16, 2016 at 7:00 p.m.

Commissioner Rhodes stated that Church Hill Elementary School had three teacher nominated for School Teacher of the Year.  Ms. Tamara Forte was the winner of the Queen Anne's County Teacher of the Year.  Also nominated was Cassandra Hostler and Paul Taylor.  He added that in the past, to show our support for the teachers, the Town has made a donation to those nominated and especially to the winner.  Commissioner Rhodes made a motion that the Town present a $200 gift card to Ms. Forte, a $100 gift card to Ms. Hostler and a $100 gift card to Mr. Taylor.  Commissioner Raffetto seconded the motion.  The motion passed 3-0.

Commissioner Rhodes also mentioned that the Church Hill Theatre would appreciate being able to use the vacant bank building on the evening of June 11, 2016 for a small reception for their trustees and sponsors.  The Commissioners agreed to allow this.

Sewer System:

Flow Reports:  Each Commissioner had a copy of the report.

MES FY17 Budget:
Maryland Environmental Service sent their quote for operating the sewer plant for another year for the Town at $43,162.00.  Commissioner Rhodes made a motion to accept their budget for the FY17 year.  Commissioner Raffetto seconded the motion.  The motion passed 3-0.

 Fidelity Power Systems Quote for Repairs: During a maintenance check, they noticed that the generator at the North Pump Station is in need of a little work.  They want to replace the primary and secondary fuel regulators and a starting battery at a cost of $1,655.60.  Commissioner Rhodes made a motion to allow Fidelity Power Systems to make the necessary repairs.  Commissioner Raffetto seconded the motion.  The motion was passed 3-0.

Commissioner Rhodes made a motion to recess the regular meeting and enter into Executive Session.  Commissioner Raffetto seconded the motion.  The motion passed 2-0.  The meeting was recessed at 7:35 p.m.

Pursuant to the Annotated Code of Maryland, State Government Article: Sections 10-501 through 10-512, §  (a), (7) to consult with counsel to obtain legal advice; "The Town Commissioners held a Closed Session at 7:35 p.m. in Town Hall, 324 Main Street, Church Hill, Maryland."  The Commissioners adjourned the Closed Session at 8:00 p.m.  Those in attendance were Commissioners John P. Griffin, Sr., Charles M. Rhodes, Jr., Edward C. Raffetto, Jr., Town Attorney Karen Ruff and B. Ross Rhodes, Jr. for Town Administrator Nancy Lindyberg.

No action was taken and Commissioner Rhodes made a motion to return to regular session at 8:00 p.m.  Commissioner Raffetto seconded the motion.  The motion passed 3-0. 

Commissioner Rhodes made a motion to adjourn the regular session at 8:00 p.m.  Commissioner Raffetto seconded the motion.  The motion was passed 3-0. 

The next Town Meeting will be Monday, May 16, 2016 at 7:00 p.m.
